A City That Measures Its Trees
Tree Removal in Southport is not something to do on impulse. The city's Unified Development Ordinance protects hardwoods with a single trunk of 8 inches DBH or more, conifers of 12 inches or more, and specimen trees of any species at 30 inches or more. It also treats Heritage Live Oaks as a signature resource of the city. On a previously platted lot with a one- or two-family home, you need a permit to remove a regulated tree within any setback, or to build within its critical root zone there, and a permit to remove a specimen tree anywhere on the property.
What happens when someone skips the permit
The ordinance sets penalties of $100 per inch DBH for removing a tree in violation, $200 per inch after notice, and $300 per inch for removing a city-owned tree. When a lot is cleared and the tree count can't be determined, the residential penalty is $1.00 per square foot of the whole lot plus replanting. In late 2023, the Board of Aldermen considered a case in Indigo Plantation where trees were cleared for a driveway and pool without a tree permit; the calculated fine was $46,583. The board instead required a city-set mitigation plan and payment for the cleared portion, estimated at a quarter of the lot. Aldermen made clear they meant to keep enforcing the rule.
Replacing what comes down
Removed trees are generally replaced to match the DBH taken out, but vacant residential lots and one- or two-family homes mitigate 25% of the removed DBH. Where canopy trees are removed, at least a quarter of the replanting must be Heritage Live Oak; where live oaks are removed, half must be live oak. Canopy replacements start at 3 inches DBH, and mitigation trees must go in within a year of the permit. Dead, severely diseased or structurally failing trees that threaten a building don't require mitigation, and permits are issued for trees that meet those criteria.
A canopy with famous trees
Southport's Forestry Committee has worked with the city to plant more than 400 trees over the past 20-plus years. Its walking tour includes the Bay Street Live Oak, a member of the Live Oak Society, and the Indian Trail Tree in Keziah Memorial Park, which local lore says could be 400 to 800 years old. In 2018 an arborist spotted sawdust from an unidentified wood-boring insect in that tree during routine fertilization, and insecticide stopped further damage. Southport is also described as the warmest place in North Carolina, with a yearly average of 65.0 degrees.

Southport Questions
Do I need a permit to remove a tree from my Southport yard?
If it's a protected tree (hardwood 8 inches DBH or more, conifer 12 inches or more) inside a setback, or a specimen tree of 30 inches or more anywhere on the lot, yes. Smaller trees and those outside setbacks on an existing home lot generally don't need one. Check with the city's UDO Administrator if unsure.
What if my tree is dead or about to fall on the house?
Dead, severely diseased or failing trees that threaten a structure are among the criteria for granting a permit, and they don't require mitigation. If a tree is an immediate danger, contact the city right away; the ordinance allows action for trees that immediately endanger public safety.
How much replanting will I have to do?
For a one- or two-family home, mitigation is 25% of the DBH removed. For example, removing a 20-inch oak would mean planting 5 inches of DBH, such as two 3-inch canopy trees rounding up. If live oaks were removed, half the replanting must be live oak.
