Where a Woodpecker Changes the Plan
Tree Removal in Boiling Spring Lakes involves rules most towns never deal with. The city lies in habitat for the red-cockaded woodpecker, a bird that depends mainly on longleaf pine forests and was listed as endangered in 1973, then downlisted to threatened in October 2024. A family group needs more than 75 acres of territory, and the birds nest in cavities in living pines. That's why the city screens tree removal applications to see whether a parcel sits in woodpecker habitat, and why some lot owners need written authorization from the U.S. Fish and Wildlife Service before they cut.
The city's own tree rules
Boiling Spring Lakes has had a strict tree ordinance since 2006. Under the current text, trees up to 7.9 inches DBH can come down without a permit on most parcels. On developed lots, trees within 15 feet of the house, septic system or pool, or within 5 feet of detached buildings or driveways, can generally be removed. Significant Trees are flowering dogwood, American holly and live oak at 8 inches DBH or more, plus any tree of any species at 24 inches or more. On single- and two-family lots, owners mitigate 25% of the DBH of Significant Trees removed. Residential removals can also be approved with insurance documentation, as long as at least one inch of DBH per 220 square feet of lot area remains.
Woodpecker trees
The ordinance says no tree with a red-cockaded woodpecker nest may be cut, regardless of size, without the Fish and Wildlife Service's express written consent. The city has worked from a federal map with red zones (active clusters plus a 200-foot buffer), blue zones (foraging areas) and green zones (no activity). In 2026, city staff reported that USFWS now wants every parcel reviewed before clearing through its online IPaC system, and they proposed repealing the city's own clearing-permit role so owners go straight to the federal agency. Because that was under review in 2026, ask the city's planning office what the current process is before you schedule any work.
A town of lakes and springs
The city takes its name from nearly 50 springs and lakes, and its main spring discharges about 43 million gallons a day. It covers about 24.09 square miles of land along NC 87, about 22 miles from Wilmington. During Hurricane Florence, the Sanford Dam that held back the main lake breached around 7 p.m. on September 15, 2018, and FEMA-funded repairs were still underway in 2024. Soggy ground around the lakes is one more reason big pines near houses can fail.
